The sole accused in S.C.No.277 of 2010, who was tried and convicted for offence under Section 302 IPC and imposed with a sentence of life imprisonment and to pay a fine of Rs.5,000/- in default to undergo 2 years rigorous imprisonment and also convicted for offence under Section 201 IPC and imposed with a sentence of one year rigorous imprisonment, vide judgment dated 26.07.2012, has filed this appeal challenging the said conviction and sentence. 2. Facts leading to the filing of this appeal necessary for the disposal of this appeal are narrated as follows: 2.1. The appellant/accused is the husband of Smt.Sudha (since deceased) and he married her about 13 years prior to 22.04.2010 and since there was no issue, his wife undergone treatment for the purpose of giving birth to a child and in this regard, the appellant/accused had spent huge sums of money. Since the treatment undergone so far did not yield any desired result, the couples approached Dr.Kalaiselvi of G.V.K. Hospital, Salem about 20 days prior to 22.04.2010 and on examination, prescribed certain medicines to the wife of the appellant/accused with an advise to come after 20 days. Accordingly, on 21.04.2010, the appellant/accused took his wife to the said hospital and after conducting some tests, the wife of the appellant/accused was advised to come on the next day for laproscopy treatment.
